Mediation

Mediation is often the most affordable divorce option, and also produces some of the strongest, most durable settlements.

Mediation offers couples a productive, private and affordable option for divorce. In mediation, Attorney Fishman represents neither party, but helps both spouses understand the options, issues and possible resolutions available to them. An experienced mediator, Attorney Fishman guides the parties to develop solutions that best fit their families and finances, all within the privacy of the mediation process and away from the stresses and polarizing effects of the courthouse.

During mediation Attorney Fishman will prepare all of the required court filings, including initial documents, Financial Affidavits and Settlement Agreement. In contrast to litigated divorce, where court appearances may be ongoing, the goal in mediation is to make only one final appearance, for which you will be thoroughly prepared by Attorney Fishman.

Collaborative Divorce

In Collaborative Divorce you work with specially trained Collaborative lawyers, mental health and financial professionals who educate, support and guide you in reaching balanced, respectful and lasting agreements.

Collaborative Divorce utilizes the strengths of specially-trained attorneys in a team-focused setting, with the goal of producing an enduring settlement for you and your family. The Collaborative approach offers a safe and dignified environment to reduce the conflict of divorce and minimize its impact on you, your children, your family and your life.

In the Collaborative process the parties agree to voluntarily disclose all relevant material and make good-faith efforts to negotiate a fair and equitable settlement with the assistance of their collaborative attorneys. Other matters, including parenting and complex financial matters, may require the assistance of complementary professionals, whom the parties may hire together.

Collaborative Practice provides you and your spouse with the support and guidance of your own lawyers without going to court until the final, uncontested, hearing.

Traditional Representation

Some situations simply require that an attorney represent the client as an advocate.

When traditional legal representation is sought, Attorney Fishman provides experienced legal counsel for divorce, parenting issues, child support, adoption and other family matters. Attorney Fishman represents clients in all phases of litigation, from initial filing to post-judgment modification.
